The purpose of this Liability Release and Photo Authorization is to provide Arboretum San Antonio (“ASA”) and any person or persons responsible for planning the meetings, workshops, or field trips (“Event”) with a release of all liability associated with my participation in the Event sponsored by ASA and to authorize the use of my image in photos and videos.
I understand that any Event involving activities in nature or otherwise may expose me to a risk of injury. ASA has warned me that the Event may involve climbing, hiking, planting etc. and I have taken into account my own physical condition prior to my participation in these activities.
By agreeing to participate in the Event, I accept and assume all risks and responsibilities for any and all claims for property damages and/or personal injury to myself regardless of the nature or cause of the damage or injury and hereby release ASA from liability for any and all property damage, personal injuries or other claims arising from my participation in the Event, including those that are known and unknown, foreseen and unforeseen.
Additionally, I agree to indemnify, defend and hold ASA harmless from any claim for property damage or personal injury in connection with my participation and/or activities in the event, including without limitation, when such claim arises from ASA’S own negligence. I further agree not to commence or prosecute any action, suit or other proceeding against ASA in connection with any property damage or personal injury resulting from my participation in the Event.
Permission is granted to ASA to use photographs and/or videos of me taken at any time during the ASA-sponsored activity in publications, news releases, and in other communications related to the mission of ASA.
